SCAORA Passes Resolution Condemning BJP MP Nishikant Dubey's Recent Statement Against CJI

The Supreme Court Advocates-on-Record Association (SCAORA) today passed a resolution expressing its deep dismay and unequivocal condemnation of the recent statements made by BJP MP Nishikant Dubey that the Chief Justice of India is "responsible for all civil wars in the country".“Such remarks are not only factually baseless and deeply irresponsible, but they also amount to a direct and unwarranted attack on the independence, dignity, and majesty of our country's highest Constitutional Court. These statements are defamatory in nature and seek to lower the judiciary's authority in the eyes of the public.”, the SCAORA resolution stated.Mr. Nikhil Jain, Hony. Secretary (on behalf of the SCAORA) in the resolution added that the independence of the judiciary is a fundamental tenet of our Constitution, and any attempt to undermine it through reckless allegations is unacceptable. While individuals may disagree with judicial decisions, such disagreements must be expressed within the bounds of dignity, constitutional decorum, and legal propriety. “It is a fundamental tenet of our democracy that the judiciary remains independent and is respected as one of the key pillars of the Constitution. While individuals may have disagreements with particular judgments or orders of the courts, the expression of such disagreements must remain within the bounds of dignity, constitutional decorum, and legal propriety.”, the resolution said. “The use of scandalous, derogatory, and inflammatory language against the Hon'ble Chief Justice of India and the institution of the Supreme Court, particularly for personal or political mileage, is wholly uncalled for, sets a dangerous precedent, and undermines the faith of the common citizen in the rule of law.”, the resolution further stated. Lastly, the Association “urged all public representatives to exercise restraint, uphold constitutional values, and respect the dignity of the judiciary.” “We also stand in solidarity with the Hon'ble Chief Justice of India and the institution of the Supreme Court in the face of such irresponsible and damaging rhetoric.”, the resolution concludes.The Resolution was resolved by the Majority i.e., Mr. Vipin Nair (President), Mr. Nikhil Jain (Hony, Secretary), Mr. Vishal Prasad Joint Treasurer) and the following Executive Members Ms, Reena Pandey, Dr. Mecnakshi Kalra, Ms. Astha Sharma, Aditya Giri and A. Selvin Raja.
