    A bench comprising the Chief Justice of India NV Ramana, Justice Surya Kant and Justice Hima Kohli to continue hearing  TODAY on the petition challenging the Constitutional validity of Section 124A of Indian Penal Code which deals with the law of Sedition in India.

    The bench will consider today the preliminary issue of whether a reference to a larger bench is required, as a 5-judge bench in the Kedar Nath decision of 1962 had retained the section after reading it down.

    The Centre informed the Supreme Court on Monday through an affidavit that it has chosen to reexamine and reconsider Section 124A of the Indian Penal Code which criminalises the offence of sedition.

    The Centre submitted that there are divergent views expressed in the public domain by various jurists, academicians, intellectuals and citizens in general regarding this Section.

    The Union has stated in the affidavit that in tune with the Prime Minister's notion that at a time when our nation is marking 75 years of independence, it intends to work towards shedding the 'colonial baggage' while justifying its decision.

    In that spirit, the Centre submitted that it has scrapped over 1500 outdated laws since 2014-15. It has also ended over 25,000 compliance burdens which were causing unnecessary hurdles to the people of our country. Various offences which were causing mindless hindrances to people have been decriminalised, the affidavit said.

      Justice Kant : You have used the word "appropriate forum" will reexamine. Why not the Central Govt through your Ministry issue a direction to States that matters under Section 124A IPC be kept in abeyance till the matter is under reconsideration.

      CJI : We can’t ask everyone to go attend the courts and be in jail for fee months. When Govt itself has shown concerns about misuse how will you protect them?

      We have to balance the people who are jailed and people who are going to be booked?

      SG : The filing of FIRs and investigation are done by State Govts. Centre does not do.

      SG : Whenever there is a misue, like the example given by the Attorney General, there are constitutional safeguards.

      CJI : We should not appear that we are unreasonable. Now, there are concerns. One is cases whihc are pending. And misuse. AG other day said even for chanting Hanuman Chalisa sedition case was taken. How are we going to protect these issues?

      CJI : The affidavit says the Prime Minister has been congizant of the issues relating to civil liberties and that he believes at a time of 75th year of independence, nation wants to shed colonial baggage including outdated colonial laws.

      GS : There is another disturbing aspect...there is a pattern..when the privacy case argument was almost over, the Centre said they are setting up a committee..in marital rape case too similar...

      Sr Adv Gopal Shankaranarayanan submits that the affidavit of the Centre cannot speak for the Parliament. Refer to a quote from Sanjeev Coke judgment on that.
