    Supreme Court has on Tuesday granted relief to students denied permission to appear in the first year professional MBBS exam by AIIMS Gorakhpur on account of low attendance by directing the Management to hold another test. The Court has directed that an exam be conducted for 11 students, including 10 petitioners and one student with a similar status as that of the petitioners.

    A division Bench of Justice Nageswara Rao and Justice Ravindra Bhat clarified that the order has been issued considering the peculiar circumstances of the present case in wake of the Covid19 and should not be taken as a precedent.

    The Court has also observed that it is not necessary to get into contentions given by the college in the present case, and taking account of the pandemic and difficulties posed by Covid 19, the students should be permitted to take the exam for First year professional MBBS

    The present plea was filed by students aggrieved by decision of AIIMS Gorakhpur to not permit them to take MBBS first Year professional examination and supplementary examination on account of shortage of attendance.

    The Petitioners contended that onset of the pandemic had made the management decide that the students leave the campus in March 2020. Since some of the petitioners belong to remote areas, they were unable to attend the online classes.

    The Counsel for AIIMS however submitted that even after extra classes the students did not fulfill the required criteria. As the first year exam has already been conducted, the students have to forego an academic year and take exams with their juniors.

    Supreme Court in its previous hearing had observed that these students should be given one last chance, and an exam should be conducted for them.

    "We cannot decide their fate in the exam but they should at least get an opportunity" Court had stated.
