    The Supreme Court on Friday expressed serious concerns over the shutting down of metro stations in Delhi ahead of the October 10 protests announced by the CJP and opposition parties in Delhi against the Chief Election Commissioner.

    The Court observed that the total shutdown of the services would affect the rights of citizens who are entitled to avail the services.

    A bench comprising Chief Jsutice of India Surya Kant, Justice Joymlayla Bagchi and Justice V Mohana was hearing the petitions challenging the curbs imposed in Delhi.

      Sibal: Ramlila Maidan taken away

      Bhushan: If they were denying Jantar Mantar, they could have given permission for Ramlila Maidan. Not done

      SG: if somebody becomes ill there, ambulance can get there with difficulty

      Sibal: Jantar Mantar is a designated site

      CJI: There are govt residences there. Some MPs stay in front lane there. Lots of problems even to protestors. They are denied toilets there.

      J Bagchi : We are taking cognizance of railways notice and metro issue

      SG: Depending on situation. We do not know

      J Bagchi: Closure in metro notice appears to sit uncomfortably with frequency reduction. All gates closed from 9 PM. Closure amounts to prohibition. That too until further orders. Regulate movements of trains but don't stop it altogether

      SG: But sometimes if situation so demands, complet stoppage can also be a proportionate measure.

      J Bagchi: right, it depends on the number of hours and on entirety.

      SG: Since it has fallen from your lordships

      CJI: please make sure petitions are complete in all respects

      SG: I represent a body which is answerable to the court. I am stating there is a background. On 20 June, permission was sought by organizers. It was given by the police dept. I will place it on record. Written document was given that we will vacate. It continued for 17 days. permission was for 1 day. during that, there were several penal violations of guidelines. They started in restricted area of Parliament buidling

      CJI: In farmers' case, I had passed order that you can't occupy place permanently because others also have rights

      SG: Parliament is not just a political...a symbol of sovereignty of nation. They can't go and enter Parliament...I don't want to touch wounds...200+ police personnel were injured. Internet ban is only from Raisina Road...within 4 kms. These are norms accepted in judgments. Day before yesterday...please see videos. Lady police officers were molested, injured. Please see any video. Way in which police has shown exemplary restraint. They were not doing anything. That was also unlawful protest - because it was not permitted.

      CJI protestors' issue is not before us today. their issue is confined to common citizenry

      SG: we know who he represents

      Gopal S: who do you (SG) represent?

      SG: Proportionate measures will be taken. I will not risk life/safety of any citizen. Calls are being given wherever you are, march to Delhi.

      J Mohana if something untoward happens to citizens...you have to keep in mind. they have duty to protect!

      CJI: Many problems is because of geographical location of this area. Can't you identify some other open space wherever peaceful protest can take place? You need to provide some faciltiies. Someone may face health issue.

      CJI: Citizens are entitled to these facilities. 2nd communication is...traffic congestion anticipated around Nizamuddin etc. all main express trains reaching new delhi are cancelled at source

      Sibal: It means a Kerala train can't come here if it's reaching Delhi

      N Hariharan: lawyers have cars, but where are the roads to drive? how are we to overcome? complete barricading

      CJI: One celebrated principle is of proportionality. Do only to extent...that principle need to be kept in mind. Maybe that out of abundant precaution you have done it, you do that. Law and order is your responsibility. It's not state property only. There are daughters, senior citizens...they travel, they also need to be protected. No difficulty in measures, but make sure that everything is not halted

      SG: Will put it to govt

      CJI: Barricading may also be revisted. If you have a barricade at A place, then so and so road will be available. notify online...

      SG: I would now request them to not interrupt me. I will make my submissions now.

      Nitya Ramakrishnan: We have not completed. What delhi police is doing - going from mosque to mosque. there is picure and video. they can't intimate citizens like that.

      CJI: we can't comment anything unless something comes to us. why they have gone, whether they should have gone...if there are law and order reasons...if they are unjustified

      Sibal: Citizens should not be harassed. if you can regulate protestors

      Counsel mentions closure of metro stations: yesterday, there was an order to close 57 metro stations. This violates minimal invasiveness, doctrine of proportionality

      CJI: In the absence of organizers, we are concerned with closure of metro etc. Mr SG, we have concern about this. Our concern is about 100s, 1000s of commuters coming from Greater Noida, South Delhi for livelihood...students...on behalf of common citizenry, we are saying this should not be stopped. [you can't halt everything.] Main communication says 'likelihood of unruly movement'...what is the regulatory measure? frequency of metros may be reduced. it's not completely closed. Lawyers have cars...What about clerks, etc.? for that we would like you to do something immediately.
