The Supreme Court on October 15 granted bail to Sandip Ghosh, former RG Kar Medical College Hospital at Kolkata, who was chargesheeted in a Central Bureau of Investigation (CBI) case involving alleged financial irregularities at the college and manipulation of merit scores to accommodate undeserving candidates.
A bench of Justices MM Sundresh and Justice Prasanna B Varale allowed Ghosh's appeal against the Calcutta High Court's February 23, 2026 order rejecting his bail application.
The Court took note of the period of incarceration undergone by Ghosh and the progress of the trial, observing that he had been in custody for more than two years and that only seven out of 147 witnesses had been examined so far.
"In such view of the matter, considering the period of incarceration and also the stage of the trial, we are inclined to set aside the impugned order passed by the High Court and allow this appeal," the Court said.
The Supreme Court accordingly set aside the High Court's order and granted Ghosh bail on such terms and conditions as may be imposed by the concerned trial court.
Ghosh was chargesheeted in Special Case No. 1 of 2025, arising out of a CBI case registered on August 24, 2024, by the agency's Anti-Corruption Branch in Kolkata.
The case involves allegations of criminal conspiracy, criminal breach of trust, cheating, forgery and use of forged documents under Sections 120B, 409, 420, 468 and 471 of the Indian Penal Code, along with offences under the Prevention of Corruption Act.
The allegations against Ghosh relate to two aspects: financial irregularities at the college where he was the Principal, and the alleged accommodation of undeserving candidates through manipulation of merit scores.
Ghosh had approached the Supreme Court after the Special CBI Court rejected his bail applications on January 7, 2025, followed by the Calcutta High Court's dismissal of his plea on February 23, 2026.
Senior Advocate Siddharth Aggarwal along with AOR Aditya Giri and Advocate Hemant Kalra appeared for Ghosh, while Additional Solicitor General Suryaprakash V.Raju appeared for the CBI.
