The Supreme Court, on Friday, issued notice in a plea filed by a medical student desirous of giving up her seat at Kasturba Medical College, Manipal, and participating in second round of counselling of NEET-PG 2022-23. Last year she took admission at the said college and this year she has appeared for NEET-PG 2022-23. The college authorities are demanding payment of the balance tuition fee of two remaining years in the three years course, in terms of the Bond furnished at the time of admission, to release her original documents.

    "Issue notice, returnable on 25.11.2022."

The matter was listed for admission before a Bench comprising Justices Ajay Rastogi and C.T. Ravikumar. The Bench asked the Medical Counselling Committee and the other respondents to permit the petitioner to participate in the NEET-PG Counselling scheduled from 26.10.2022 to 30.10.2022. It further noted that if the petitioner qualifies in the second round counselling she may be permitted to join without insisting on furnishing the original documents.

Advocate, Mr. Deepak Prakash appearing on behalf of the petitioner apprised the Bench that she appeared in the NEET-PG Examination for academic year 2021-2022 and she joined post-graduate course in MS (Oto-Rhino- Laryngology) at Kasturba Medical College, Manipal on 24.02.2022 as a Junior Resident.

However, he submitted that as the petitioner was interested in joining a post-graduate course in another discipline; she again appeared in the NEET-PG examination for the academic year 2022-23. She qualified and wants to appear in the second counselling, which is to be held from 26.10.2022 to 30.10.2022.

The petitioner is apprehensive that if she is allotted a seat in the second round of counselling, she would be required to furnish her original documents, which at present is lying with the Kasturba Medical College, Manipal. The college is demanding the balance tuition fee of the remaining two years (3-year course). Therefore, the petitioner was constrained to approach the Apex Court with her grievance.
