The Supreme Court allowed urgent listing of a plea challenging an OMR Answer Sheet in the NEET-UG Exam 2026, after it was submitted that the National Testing Agency is likely to destroy the records tomorrow.
On a mentioning, a bench of CJI Surya Kant and Justice Joymalya Bagchi agreed for listing of the matter tomorrow. The matter will be heard by Justice PS Narasimha's bench.
The petitioner's counsel submitted, "The OMR Sheet is under question. NTA will destroy it tomorrow because tomorrow is 90th day...".
The CJI initially directed listing of the matter on Friday. However, the counsel stressed that the matter may be heard tomorrow, as according to rules, the NTA destroys all original records 90 days after the exam (which period is expiring tomorrow).
To consider whether the petitioner approached the Court belatedly, the bench questioned the counsel on the time gap between the date of exam and filing of the petition. The counsel then explained that the petitioner went through proper channels, first approaching the High Court and then the Supreme Court.
He highlighted that the petitioner's intra-court appeal was dismissed by a Division Bench of the Gujarat High Court on October 12.
"Why will they [NTA] destroy records tomorrow?" CJI questioned the counsel. The counsel replied that NTA regulations provide for such deletion after 90 days. He added that the result was declared on July 16 and tomorrow will be the 90th day since.
Ultimately, the bench agreed to list the matter tomorrow.
