'What Happens To Indians Born & Brought Up Here?': Supreme Court Asks OCI Students Seeking Admission In Non-NRI Seats

While hearing a batch of petitions challenging the Centre's 2021 notification as per which OCI students are entitled to apply only to NRI seats in NEET admissions, the Supreme Court on Wednesday orally asked whether Overseas Citizens of India (OCI) are entitled to be treated at par with Indian Citizens.
Justice S. Ravindra Bhat today remarked, "Where is your entitlement? You are not an Indian Citizen. You are a foreign student. Whether it is NRI or you.... In fact we allow quota for everyone. An Indian citizen is discriminated against. You are not an Indian citizen. You are here on visa. All of you want quota separately. What happens to our own citizens who are born and brought up here?."
However, the court was not inclined to hear the petition today after Additional Solicitor General for India Aishwarya Bhati, appearing for the Respondent Union of India, submitted that, similar other matters are posted tomorrow and requested for tagging the present petition along with that batch.
The Counsel appearing for the petitions submitted that the present matter has a wide ranging challenge to the Indian Citizenship Act.
The bench comprising Justices A.S. Bopanna and S. Ravindra Bhat adjourned the matter today and ordered that it be listed before the same bench on the same day as the other similar matters.
During the last hearing, the Supreme Court had asked the OCI Students, "Why don't you apply for Indian Citizenship?"
Last year, the Supreme Court had passed an interim order allowing OCI candidates to apply to general seats for NEET admissions. However, the Court had clarified that the interim order was confined only to the 2021-2022 academic year.
