Supreme Court Seeks UP Govt Response On Policy For Premature Release Of Prisoners Above 80 Years Old

The Supreme Court of India has issued notice to the Uttar Pradesh Government seeking their response to whether the State has any existing policy to consider the premature release of accused who are 80 years old or above and convicted on long drawn trial.
Advocate-on-Record, Mr. P.V. Yogeshwaran appearing on behalf of the Petitioner before a bench comprising the Chief Justice of India, N.V. Ramana and Justices Surya Kant and Hima Kohli pointed out that the petitioner at present is 80 years of age.
The Bench noted that the offence was committed in the year 1985 and after a long drawn trial the final order in the appeal before the Allahabad High Court was passed only in the year 2019.
Considering the peculiar facts and circumstances of the case, the Bench issued a limited notice to the State of U.P. to examine if the State has an existing policy to address the issue at hand.
Taking into account the urgency in the matter, the Bench directed the Registry to list it immediately after service is complete on the Government of Uttar Pradesh.
