Umar Khalid has filed a review petition before the Supreme Court, seeking to review the January 5 order, which denied him bail in the Delhi riots larger conspiracy case. The matter is listed on Wednesday.
It may be recalled that a bench comprising Justice Aravind Kumar and Justice NV Anjaria had denied bail to Khalid and another co-accused, Sharjeel Imam, observing that the materials showed a prima facie case against them under the Unlawful Activities (Prevention) Act, 1967. It stated that prosecution materials prima facie disclosed "a central and formative role" and "involvement in the level of planning, mobilisation and strategic direction extending beyond episodic and localised acts."
At the same time, the Court granted bail to some of the other accused in the case - Gulfisha Fatima, Meera Haider, Shifa Ur Rehman, Mohd. Saleem Khan and Shadab Ahmed.
The Court had also imposed an embargo on Khalid and Imam, that they can renew their bail applications only after the examination of protected witnesses or after one year from from January 5.
The review petition was mentioned by Senior Advocate Kapil Sibal(for Khalid). He stated that the matter had been listed on Wednesday and requested that it be heard in an open Court.
Sibal: "I wanted to make a mention, mylords are hearing the review petition in Umar Khalid's case. It is listed on Wednesday, I believe. My request is, it is only for your consideration if you could have it in an open Court."
Justice Kumar responded: "We will look into the paper, and if required, we will call it."
