Advocate: rights of deity is protected by customs and followers. the rights of deity are indirectly under article 25, deity will not say anything but the followers.
in sabarimala, there is no violation of articles 14 and 15. in hindu religion, temple is a place of worship and not a place for picnic.
Advocate: in article 25, the term religion and article 26, the term religious denomination. there are four types of religion religious originated in india and have denomination outside, religious originated broad, religious which don't have followers anymore and now fourth type is there may be a new religion in nature.
religious denomination is sub group. constitutional framers didn't provide any definition- it is not limited to border, it has international features. islam and christinanity originated in foreign then how can we apply test to something that originated in foreign?
J Nagarathna: suppose there is a temple which wants to have a festival, but you can't block all cars. this has nothing to do with religious. any activity which is not religious, that is the autonomy, they can decide what is the religious practice and court can't sit in judgment. suppose there is a certain way of worship and that is the autonomy and court can't sit in judgment and say you can't in article 26.
Advocate Akshay for Hindu Dharma Sabha: on definition of religious denomination- certain exclusivity and ridigitty has been applied over the period of time. refers to a judgment- to ask a religious denomination to show how exclusive you are may not be consistent
Advocate Kumar: article 26 doesn't deal with right of individuals.
Advocate Rajnish Kumar: article 25 is not confined to citizens allow but all persons residing in india. what is the interplay between rights of persons and religious denominations- while article 25(1) protects religious freedom, article 26 deals with collective rights.
