Sr Adv Raju Ramachandran (for TN assembly): Impugned resolution of 2003 was withdrawn in 2004 and that aspect is not noticed/pointed out...affidavit is on record, but referral order does not show taht either side pointed this out to the court...this will be argued as preliminary objection

SG Tushar Mehta: Point is, this may perhaps be an academic exercise

CJI: Please don't indulge in academic exercise. If issue survives, we will decide. If it doesn't, we can wait for proper opportunity. Other part-heard cases can be heard instead

Kapil Sibal: Issue is of great significance
