    The District Consumer Disputes Redressal Commission, Bangalore (Urban) has held a hotel liable for deficiency in service for serving only biriyani without any pieces of chicken to a customer who had ordered Chicken Biryani.

    The commission presided over by President M. Shobha P, partly allowed the complaint and directed the owner of the hotel to refund Rs 150 paid towards the amount paid for the Chicken Biryani and Rs.1,000/- as compensation within 30 days from the order.

    As per the complainant, he had gone to the hotel with his wife to get a parcel for dinner, since there was no gas cylinder at home. He submitted that he had paid Rs.150 to get Chicken Biryani and had taken the receipt from the counter.

    It was submitted that upon coming home, the man discovered that the biriyani was only rice, without any pieces of chicken.

    The complainant argued that he had called the Opposite party hotel (OP) immediately, who said that they would send another box of chicken biriyani to him within 30 minutes, but failed to do so.

    “With no other option at the late hours, he and his wife had the available biryani rice. Even after the intimation given to the OP, OP did not send, which caused deficiency on the part of OP and also mental agony to the complainant,” the Bench noted.

    Thereafter, the complainant sent a notice to the hotel on 28.04.2023 but it did not reply to the same. Hence he approached the commission seeking directions for payment of costs of Rs 30,000 along with a refund of the price paid. 

    On going through the records, the Commission said that the amount received by the hotel for normal rice instead of Chicken Biryani is unjust and unfair.

    If the OP is genuine in his attitude OP could send the Chicken Biryani after it came to his notice but OP did not do so, it further held. 

    Accordingly, in partly allowing the complainant's plea, the Commission directed payment of Rs 1,000 along with a refund of the price of the biriyani upon observing that the act of OP in the situation of inconvenience to prepare food at home without a gas cylinder, definitely caused mental agony to the complainant and his wife.
