Delhi District Commission Holds Tata SIA Airlines Liable For Damaging Baggage Of The Complainant

The Delhi District Consumer Disputes Redressal Commission headed by President Monika A.Srivastava and Member Kiran Kaushal has held Tata SIA airlines liable for damaging the baggage of the complainant. A compensation of Rs. 10,000 has been ordered to be paid towards damage and stress caused to the complainant. Brief background: The complainant booked a flight from Delhi to Mumbai on 25.02.2023 and was carrying a single cabin bag. The flight was full and there was no space left to keep overhead cabin bags. Therefore, the staff requested the complainant to give his bag in check-in baggage. On this, he requested the staff to handle the bag with due care and responsibility since it contained fragile items. However after landing, when the complainant went to the conveyor belt to take his bag, he was shocked to see that his bag had been extensively damaged and broken. This issue was immediately raised by the complainant with the authorised person of the Company but the Company failed to redress the issue. Therefore, the complainant approached the consumer forum praying for appropriate compensation. No one appeared on behalf of the airline company. Therefore, the Commission proceeded after hearing the submissions of the complainant only. Observations: The Commission went through the photographs of the broken bag filed by the Complainant and observed that one of the wheels of the bag had been damaged. Moreover, neither any compensation was provided nor any action was taken by the Company for the said damage. Thus, the Company was held liable for providing deficient services to the complainant and Rs. 10,000 was directed to be paid as compensation. Case name: Manan Batra vs M/S Tata SIA airlines ltd.
