Cab-EEZ Reaches Settlement With Tata Power EV On Rs 1.9 Crore Debt Over Unmanned EV Charging Services, NCLAT Told

The National Company Law Appellate Tribunal (NCLAT) on Friday was informed that Cab-EEZ Infra Tech Ltd. and Tata Power EV Charging Solutions Ltd. have reached a settlement in the insolvency proceedings pending before the National Company Law Tribunal (NCLT) Mumbai against the electric ride hailing company. Recording the development, a bench of Chairperson Ashok Bhushan and Technical Member Barun Mitra disposed of Cab-EEZ's appeal against the insolvency appeal. Counsel for Cab-EEZ submitted that the resolution professional (RP) has already filed a Section 12A application before the NCLT Mumbai seeking withdrawal of the corporate insolvency resolution process (CIRP). Taking note of this, the bench observed: “In view of the above we are of the view that no useful purpose will be served in keeping the appeal pending. Appeal is disposed with observation that adjudicating authority may consider and take a decision on the 12A application and further step shall be taken only thereafter. With this observation, we dispose of the appeal.”The appeal stemmed from an order passed on October 15 by the NCLT Mumbai Bench admitting Tata Power EV Charging Solutions' insolvency plea against Cab-EEZ Infra for an unpaid operational debt of Rs 1.9 crore. The tribunal had appointed Manish Lalji Dawda as the interim resolution professional and imposed a moratorium under Section 14 of the Insolvency and Bankruptcy Code, 2016.The dispute traces back to a 2020 master service agreement between Cab-EEZ and Tata Power for unmanned EV charging services. From 2022, Tata Power EV Charging Solutions took over the services and began issuing invoices directly to Cab-EEZ. Upon continued non-payment, demand notices were issued, followed by the insolvency petition.
