Basic Structure Doctrine Applicable In Kenya: Kenyan Court Of Appeals Holds Constitutional Amendment Bill 2020 Unconstitutional

The Kenya Court of Appeals, in a landmark judgment delivered on Friday, held that the 'basic structure doctrine' is applicable in Kenya.The basic structure of the Constitution can only be altered through the Primary Constituent Power which must include four sequential processes namely: civic education; public participation and collation of views; Constituent Assembly debate; and ultimately, a referendum. the majority judges of the seven judge bench held.The majority upheld the Kenyan High Court judgment which had held the Constitution of Kenya Amendment Bill, 2020 unconstitutional and a usurpation of the People's exercise of sovereign power. The seven judge bench led by Daniel Kiio Musinga also held that the President does not have authority under the Constitution to initiate changes to the Constitution, and that a constitutional amendment can only be initiated by Parliament through a Parliamentary initiative under Article 256 or through a popular initiative under Article 257 of the Constitution.In 2018, President Uhuru Kenyatta and Raila Odinga, who were rival candidates for Presidential election in 2017, sorted out their difference and their coming together is widely referred as 'the Handshake' [picture]. Later President Uhuru Kenyatta appointed a 'Building Bridges to Unity Taskforce' to recommend administrative and other changes, The taskforce's report was followed by the appointment of a BBI Steering Committee tasked with proposing constitutional and other changes. These recommendations was later moved as a Constitution of Kenya Amendment Bill 2020 before the Parliament.At this stage, several petitions got filed before the High Court of Kenya challenging this Bill contending that it threatens to alter the functions of Parliament, the Judicial Service Commission, the County Assemblies as well as oust the mandate of the Independent Electoral and Boundaries Commission. They also contended that the Bill proposes to discard the doctrine of separation of powers and checks and balances first, by threatening to reverse the Presidential system of government, by threatening amend Chapter 9 of the Constitution on the executive. They, therefore, sought a declaration that the legal and judicial doctrines of the "basic structure" of a constitution; the doctrine and theory of unamendability of "eternity clauses" the doctrine and theory of "constitutional entrenchment clauses" and "unamendable constitutional provisions" in a constitution are applicable in the Republic of Kenya. Heavy reliance was placed by the petitioners on the Indian Supreme Court judgment in famous case of Kesavananda Bharati v State of Kerala.By a unanimous judgment, the five judge bench of Kenya High Court allowed these petitions and declared that the Basic Structure Doctrine is applicable in Kenya and also that the Constitution of Kenya Amendment Bill, 2020 is unconstitutional.Court of Appeal OrderThe Government filed appeal against this judgment before the Court of Appeal. Seven judge bench led by Justice Daniel Kiio Musinga heard the appeal. The summary of the order is reproduced below:The basic structure doctrine is applicable in Kenya (Sichale, J. A. dissenting). The basic structure doctrine limits the amendment power set out in Articles 255 – 257 of the Constitution (Okwengu & Sichale, JJ. A. dissenting).The basic structure of the Constitution can only be altered through the Primary Constituent Power which must include four sequential processes namely: civic education; public participation and collation of views; Constituent Assembly debate; and ultimately, a referendum (Okwengu, Gatembu & Sichale, JJ. A. dissenting)Civil Court proceedings can be instituted against the President or a person performing the functions of the office of President during their tenure of office in respect of anything done or not done contrary to the Constitution (Tuiyott, J. A. dissenting). The President does not have authority under the Constitution to initiate changes to the Constitution, and that a constitutional amendment can only be initiated by Parliament through a Parliamentary initiative under Article 256 or through a popular initiative under Article 257 of the Constitution. The Steering Committee on the Implementation of the Building Bridges to a United Kenya Taskforce Report (The BBI Steering Committee) has no legal capacity to initiate any action towards promoting constitutional changes under Article 257 of the Constitution. The Constitution of Kenya Amendment Bill, 2020 is unconstitutional and a usurpation of the People's exercise of sovereign power. viii.
