    The Allahabad High Court last week granted bail to one Ibnul Hussain who was arrested in July 2022 on the allegations of damaging the image of the Chief Minister of Uttar Pradesh, Yogi Adityanath by misusing the mobile phone of the informant.

    The bench of Justice Subhash Vidyarthi allowed the plea keeping in view the fact that the applicant is a 22-year-old person having no criminal history and has been languishing in jail since July 21, 2022.

    Essentially, the case was registered on the basis of an FIR lodged by the informant on June 3, 2022, alleging that there was a property dispute between the parties and when he (informant) was preparing a video in that regard, the applicant snatched away his mobile phone on some day in January 2022, however, he did not remember the date of the incident.

    Further, it was also alleged that the informant came to know that the applicant was misusing his mobile phone and SIM card to send bogus messages to officers and was damaging the image of the Chief Minister of the State by posting dirty images of him.

    Having considered the facts and circumstances of the case and keeping in view the fact that the incident occurred on an unspecified date in January 2022 and FIR has been lodged 6 months thereafter, and no incriminating material had been recovered from the applicant, the Court granted him bail.

    In view of this, the Court ordered that the Accused, booked under Sections 392, 153-A, 295-A, 195, 506 IPC & Section 67-A IT Act on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned.

    Advocate Osama Ahmad Abbasi was the counsel of the Accused.
