Allahabad High Court Directs CAT To Expeditiously Decide Ex-IPS Amitabh Thakur's Challenge To Compulsory Retirement

The Allahabad High Court (Lucknow Bench) has directed the Central Administrative Tribunal (CAT), Lucknow Bench, to expeditiously decide ex-IPS officer Amitabh Thakur's challenge to his compulsory retirement, which has been pending before the Tribunal since 2021.
A bench of Justice Jaspreet Singh passed the order while dealing with a petition filed by Thakur under Article 227 of the Constitution, seeking expeditious disposal of his pending Application filed in 2021.
Thakur approached the High Court through Advocates Dr. Nutan Thakur and Deepak Kumar, seeking an expeditious hearing of his challenge to his compulsory retirement in March 2021.
During the course of the hearing, the Counsel appearing for UOI submitted that there was no objection to an expedite order being passed.
Considering the circumstances, the High Court found that keeping the matter pending would serve no useful purpose and directed the CAT to consider and finally decide the pending Original Application as expeditiously as possible. The Court observed thus:
"...no gainful purpose will be served in keeping the aforesaid petition pending rather ends of justice can be served by directing the respondent no. 1 to consider and finally decide the pending proceedings...as expeditiously as possible".
The High Court directed the CAT to afford an opportunity of hearing to the parties, but specifically added that this should be done "without granting any unnecessary adjournment to either of the parties", provided there was no legal impediment.
Importantly, the High Court clarified that it had not examined the merits of either party's case.
"It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law", the bench remarked.
Accordingly, the petition was disposed of with the direction for expeditious consideration and final decision of the pending CAT proceedings.
