Noida Techie Death Case | Allahabad High Court Orders Immediate Release Of 'MZ Wiztown Planners' Director

    The Allahabad High Court on Thursday ordered the immediate release of Abhay Kumar, director of MZ Wiztown Planners, who was arrested last month in connection with the drowning of software engineer Yuvraj Mehta in a waterlogged pit near a construction site in Uttar Pradesh's Noida.

    A Bench of Justice Siddhartha and Justice Jai Krishna Upadhyay observed that his arrest was carried out in violation of the High Court's recent judgment in the case of Umang Rastogi and Another vs. State of U.P. and 3 Others 2026 LiveLaw (AB) 40, specifically in violation of Clause 13 of the memo of arrest.

    It may be noted that Clause 13 of the standardised memo being followed in the State requires the police to record specific details, including the material demonstrating the accused's involvement, the necessity of arrest based on evidence collected and details of documentary or electronic evidence.

    Noting the violation, the bench directed the authority concerned to release the corpus/petitioner forthwith. The writ petition was thus allowed.

    Software engineer Yuvraj Mehta drowned after falling into a waterlogged trench at a commercial site in Sector 150, Noida. Mehta took a sharp right-angle turn and, owing to foggy conditions, fell into the trench.

    A preliminary probe found the pit had been left without any danger marking or demarcation by the plot owner of an under-construction project, which was being handled by Wiztown Planners.

    Thus, the company's direction (Abhay Kumar/petitioner) was arrested on January 20 under charges of culpable homicide not amounting to murder, causing death by negligence and negligent act endangering human life.

    On February 2, a Chief Judicial Magistrate (CJM) court denied bail to him. Following this, he had moved the HC with a habeas corpus petition.
