Allahabad HC 'Prays To God' For Unity 'Till Last Breath' Of A Family Involving Husband-Wife, Minor Children

In a poignant remark, the Allahabad High Court, while dealing with a habeas corpus petition filed by a mother seeking custody of her two minor children currently residing with their father, recently expressed that it 'prays to God' for the family that they remain together until their 'last breath'. “…this Court being part of the extended family of advocates as well as litigants, is praying to God that family may unite till the end of their last breath,” a bench of Justice Saurabh Srivastava remarked as it hoped that the woman and her husband would resolve their dispute in the interest of the upbringing and better future of their children. The mother (petitioner no. 3) filed the plea claiming that petitioner no. 1 (minor son) and petitioner no. 2 (minor girl) had been illegally detained by respondent no.4 (father). Pursuant to the court's order, petitioners 1 and 2, along with their mother/petitioner no.3 and father/respondent no.4, appeared before the HC, wherein the man showed his willingness to maintain his wife at his residence. The mother of corpuses (petitioner no.3) positively replied to the proposal, saying that she was also ready to go along with her husband, especially for the betterment of her children's future. In view of this, expecting a positive outcome of the reconciliation between the parties (husband and wife), the Court posted the matter for April 28, 2025, as fresh for adjudication based on the outcome of the family reunion. Regarding the criminal cases filed by the wife against her husband and family members, the Court observed that since both husband and wife have already consented to live together peacefully with their children, this order may be placed before the concerned courts requesting that the criminal proceedings be kept in abeyance until the next date of listing of the present matter.
