Allahabad HC Orders Protection For Man Allegedly Stopped From Namaz At Home; Says State Will Be Accountable For Any Harm To Him Or His Property

The Allahabad High Court has ordered round the clock security for a Muslim man from Bareilly who was allegedly stopped from offering Namaz inside his private house.

Khan had earlier sought permission to conduct a religious congregation to offer Namaz at his private house. The State had then told the Court that does not require any kind of permission under the law to pursue an act which is his fundamental right under Article 25 of the Constitution.

It is now alleged that Khan was picked up from his house and challaned by the Police while offering Namaz. He was also threatened with demolition and made to sign blank papers.

In this backdrop, a contempt petition was filed against the State authorities.

On a pointed query as to whether permission was sought for carrying out Namaz in private property, the Additional Advocate General appearing for the State conceded that permission was actually sought from all the persons present in the house.

In this backdrop, the Court has granted police protection to Khan. "The said guards shall accompany him wherever he goes," it said.

The Court has further summoned the alleged contemnors— District Magistrate and the Senior Superintendent of Police, Bareilly for orders in the matter on March 23.
