Confederation Of Real Estate Developers Of India Withdraws PIL Against Farmers Protest From Allahabad High Court, To Pursue Appropriate Remedy

On Monday, Confederation of Real Estate Developers of India (CREDAI) withdrew its public interest litigation from the Allahabad High Court seeking direction to New Okhla Industrial Development Authority and Greater Noida Industrial Development Authority for safe egress and ingress to public at large in their offices and to demarcate a place for protesting farmers after obtaining permission from the competent authority. It has been stated in the PIL that the farmers have been carrying out regular protests and staging dharnas outside the office of NOIDA and GNIDA for various demands including payment of additional compensation, job reservations and allotment of abadi land in lieu of the land acquired by the authorities. Due to such protests, the development authorities close their gates and stop public at large from entering their premises causing hardship to the public, petitioner claimed. CREDAI, being a representative body for the developers who are carrying out works on the lands acquired by NOIDA and GNIDA, raised concerns regarding developers not being allowed in the offices of the authorities hampering the projects. It was pleaded that the protests were without any sanction by any authority and were causing greater loss to the public as development projects were being stalled. Accordingly, petitioner approached the High Court seeking directions to NOIDA and GNIDA to allot separate place to the farmers for their protests and allow entry of general public, including developers, in their offices so that development work could be carried on hassel-free. Petitioner also sought a writ of mandamus against the State with a direction to ensure adequate security in and around the offices of the development authorities. The matter was heard by the bench of Chief Justice Arun Bhansali and Justice Vikas Budhwar who dismissed the petition as withdrawn. Petitioner was directed to pursue remedy in accordance with law.
