    The Bombay High Court has pulled up RV Pharmaceuticals, manufacturers of Moon cosmetics, for allegedly violating injunctions that had stopped it from using packaging said to imitate the dark green and black trade dress of the Nova cosmetic brand, granting fresh ad-interim relief to ensure the company does not continue using the disputed packaging.

    Justice Arif S Doctor passed the order on November 11, 2025, after noting that the material on record showed a prima facie breach of the injunctions first granted in January 2017 and later made absolute in January 2021.The court said Nova had made out a case for grant of the interim reliefs as prayed.

    Ashok M Bhat, proprietor of the Nova brand, told the court that the 2017 ex parte ad interim injunction had restrained RV Pharmaceuticals from manufacturing and selling cream products under the Moon label using packaging alleged to imitate the artistic work and trade dress of Nova's cosmetic products.

    He said that despite the injunction being made absolute in 2021, RV Pharmaceuticals had recently resumed manufacturing and marketing creams using the disputed Moon packaging.

    The court recorded that despite service, RV Pharmaceuticals did not appear. Taking note of the alleged breach, it directed the company to comply with the earlier orders restraining it from adopting packaging deceptively similar to Nova's.

    The court also allowed the Court Receiver to carry out additional search and seizure operations and directed the Receiver to submit a report on the goods seized during the 2017 raid. A representative of RV Pharmaceuticals was directed to remain present at upcoming hearings.

    The injunction will remain in force until December 09, 2025, when the matter will next be heard.
