The Bombay High Court on Thursday (November 5) set aside the bail granted by a special court to controversial cop Sachin Waze, a prime accused in the infamous Antilia Bomb Scare Case - Mansukh Hiren murder case.
A division bench of Justice Girish Kulkarni and Justice Dr Neela Gokhale while pronouncing the verdict said, "Special court's order is quashed and set aside...Appeal by NIA is allowed."
A detailed copy of the order is yet to be made available.
According to the NIA, an explosives-laden Scorpio Car, along with a threat letter, was found near the Ambani's residence on February 25. Mansukh Hiran, a businessman who claimed that the vehicle had been stolen from his possession a week earlier, was found dead in a creek in Thane on March 5.
The NIA claimed that Waze wanted to reestablish his "super cop" image and thus had conspired all his to create terror in the minds of Ambani family members.
However, the special court while granting bail, noted that the Ambanis continued with their usual routine life and that there was nothing on record to show that any member of the family was terrorised.
The NIA highlighted the fact that Waze owned more than 5 high end cars and stayed for more than a 100 days in a five star hotel. All this at the time when he was earning only Rs 90,000 monthly salary.
Waze while supporting the reasoning of the special court also pleaded the ground of long incarceration.
As per the NIA, Waze was involved in the planting of explosives and Hiran's murder. They claimed that the 'murderers' had called up Waze and former encounter specialist Pradeep Sharma right after they killed Hiran, on March 4. He was arrested on March 13. The NIA subsequently arrested constable Vinayak Shinde and bookie Naresh GoreWaze's close aide API Riyazudding Qazi (crime branch unit incharge), Sunil Mane were arrested thereafter.
Waze was initially investigating the case. However, it was subsequently transferred to the State Anti Terrorism Squad and then to the NIA, in March, 2021. All the accused are booked for murder and under relevant sections of the UAPA.
