Delhi High Court Waives ₹50K Costs On Litigant, Asks Counsel To Distribute Samosas And Tea To DHCBA Employees

The Delhi High Court has waived costs of Rs. 50,000 imposed on a company while directing its counsel to distribute samosas and tea to all employees of the Delhi High Court Bar Association (DHCBA) within a week.
Justice Saurabh Banerjee passed the direction while allowing an application moved by Indus Birra Beverages seeking waiver of costs imposed in an order passed on August 20.
“Learned counsel for the petitioners is called upon to distribute samosas and tea to all the employees of Delhi High Court Bar Association (DHCBA) within a period of one week,” the Court directed.
The Company filed the plea seeking quashing of a case filed against it by a man under Section 138 read with Section 142 of the Negotiable Instruments Act, 1881.
On August 20, Justice Banerjee had imposed costs on the company after observing that it had withheld an order passed by the trial court.
The Court had rejected the plea, observing that the company made contrary statements before different Courts and also withheld by information or mislead judges with a clear intention to somehow snatch an order from the High Court.
A fresh application was filed by the company seeking waiver of the costs. Allowing the plea, the Court directed:
“Considering the factual matrix involved, the present application is allowed and the cost of Rs.50,0000/- imposed vide order dated 20.08.2026 is hereby waived.”
