The Delhi High Court recently closed a plea seeking to stop the continued streaming of the film Lady Chatterley's Lover in India on OTT platform Netflix on the grounds of containing “excessively graphic sexual scenes and frontal nudity.”

Justice Purushaindra Kumar Kaurav granted liberty to the litigant, Raj Kumar, to approach Digital Publisher Content Grievances Council which is a tier-two body under Information Technology Rules 2021 to resolve viewer complaints.

Appearing in person, Kumar argued that he had accessed the film at home, where it was inadvertently viewed by his family members, including minor children, causing mental distress and infringing his right to privacy, dignity, and peaceful enjoyment of his home under Article 21 of India.

He contended that the movie contains graphic sexual scenes, frontal nudity, and explicit acts which, taken cumulatively, are obscene, pornographic, and contrary to contemporary community standards and permissible limits under Indian law.

The counsel appearing for Netflix India submitted that Kumar's complaints had already been examined and rejected through a communication dated November 22, 2025, stating that the film did not violate the IT Rules, 2021 or any applicable law.

It was further submitted that Kumar could still pursue his grievance before the Digital Publishers Content Grievance Council (Tier-2), which is functional and chaired by a former Supreme Court judge.

Taking the statement on record, the judge disposed of the plea.

“In view thereof, the petitioner is granted liberty to approach the concerned Council and if the petitioner does so, there is no doubt that his grievance could not be taken to its logical conclusion,” the Court said.
