Candidates Eligible To Apply In Both Online And Offline Modes For Management Quota Admissions In IP University Colleges: Delhi High Court

The Delhi High Court on Friday said that the candidates intending to apply for admissions in different colleges affiliated with the Guru Gobind Singh Indraprastha University under the Management Quota seats shall be eligible to apply in both online and offline modes.A division bench of Justice Suresh Kumar Kait and Justice Neena Bansal Krishna directed the varsity to make an online portal to display the branch and college-wise seats available with it under Management Quota so that the prospective students can apply online as well as offline against the available seats. “The college shall display the list of aspirant admission seekers on the online portal as well as on the notice board of the college. The college shall prepare common merit wise list of candidates who have applied through online and offline mode. The merit list college wise shall be published online,” the bench directed. The court upheld the directions notified by the varsity in the circular published on September 22 last year which stated that prospective students can apply only online against the available seats under Management Quota, with partial modification. The bench directed the University and the Delhi Government to issue necessary orders to comply the directions, within two weeks. “It is made clear that these directions shall cease to follow for the session 2022- 23 and the seats already filled till 2022-23 under the Management Quota by colleges for different branches shall not be disturbed,” the court clarified. The bench disposed of an appeal moved by Vivekananda Institute of Professional Studies, a private institution affiliated with the varsity, challenging an order passed by the single judge on May 17. The single judge had upheld the validity of three circulars issued by the Delhi Government and the varsity in September and October last year, observing that the regulation of admission in a fair, transparent and non-exploitative manner is the heart and soul of Articles 14, 19 and 21 of the Constitution of India.“In the considered opinion of this Court there is no infirmity in this opinion rendered by the learned Single Judge and it not even challenged before this Court. The appellant is aggrieved with the directions to display online the seats available under the Management Quota and admission on merit basis,” the court said. It added that the court has not touched upon the issue of formation of Management Quota- admission monitoring committee (MQAMC) which was not under challenge, and thus, the opinion rendered by the single judge shall remain in force.“In the light of aforesaid observations, in the considered opinion of this Court, by making the aforesaid observation, the learned Single Judge has appreciated that the Act of 2007 provide sufficient mechanism with regard to admission process and has therefore, therefore directed that no MQAMC was required to be constituted and its requirement envisaged under the impugned Circular dated 22.09.2022 shall cease to operate,” the court said.
