Delhi High Court Orders Creating Of Common App For MCD, DDA & NDMC Regarding Complaints On Public Toilets

The Delhi High Court has directed that a common application be developed to be used by Municipal Corporation of Delhi (MCD), Delhi Development Authority (DDA) and New Delhi Municipal Corporation (NDMC) for attending to the grievances in relation to malfunctioning of public toilets in the national capital.A division bench comprising of Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela directed that a "meeting" of the Acting Vice Chairman of DDA and the Municipal Commissioners of NDMC and MCD be convened to discuss the prospects of development of the common application. “We expect that all these three agencies shall make their earnest endeavour to work out a solution for developing a common App so as to ease the process of making complaints,” the Court said. The Bench was dealing with a public interest litigation filed by Jan Sewa Welfare Society to ensure the availability of hygienic public urinals with clean water and electricity supply in the city.The status report filed by MCD stated that a third party audit of the toilets was conducted and that the condition of the toilets was found satisfactory.It was also stated that MCD has launched an App for receiving complaints for redressal of grievances relating to public toilets. On this, the Court directed the Municipal Corporation of Delhi to take appropriate steps to publicize availability of the application widely through newspapers and also by taking recourse of other means of publicity. Such information regarding availability of the App shall also be displayed on the respective toilets, it added. “Having regard to the utility of an App for the purposes of attending to the grievances in relation to malfunctioning of the toilets in the city, we are of the opinion that in case a single/common App is developed which is used by all the agencies namely MCD, NDMC and DDA, the same would make it easy for the citizens to lodge complaints and seek redressal in this regard,” the Court directed.The matter will now be heard on April 09. The plea seeks directions on the respondents to inspect all available and functionally constructed public urinals in Delhi and to initiate steps for the construction of more public toilets.It states that the general public in Delhi faces various issues due to poor maintenance of public toilets which are not properly maintained and also lack hygiene. It adds that lack of proper sanitation causes a “disgusting atmosphere” and infectious diseases which may cause societal hazards.Title: Jan Seva Welfare Society (Reg.) v.
