Delhi High Court Directs Meta, 'X' Social Media Platforms To Take Down Pirated Links Of 'Kannappa' Film

The Delhi High Court recently directed social media platforms Meta and X to take down pirated links of Vishnu Manchu starrer Telugu film 'Kannappa'.Justice Jyoti Singh passed the interim order on a copyright infringement suit filed by the film production Twenty-Four Frames Factory Private Limited.The plea claims that Kannappa, based on religious folkfare about Lord Shiva and his devoted follower, is one of the most ambitious projects of the production house, and its piracy is not only undermining their commercial interests but is also disrupting their contractual obligations with distributors.Plaintiff claimed 1,776 infringing links are hosted by Meta alone. Of this, 191 links have been removed so far.The suit also arrays certain rogue websites and seeks a dynamic injunction “to ensure blocking of infringing content, revocation of rogue website domain registrations and disclosure of registrant details so that proceedings under law can be taken apart from claim for damages.”As the Court issued summons on the suit, counsel appearing for Meta submitted that as per Plaintiff's own showing, 191 infringing links had been removed and the platform is ready to abide by any further direction passed by the Court.Noting that the production has made out a prima facie case, the Court ordered,“Defendant No. 2/Meta Platforms Inc. is directed to take down and disable the URLs hosting the infringing videos on Instagram and Facebook (mentioned at pages 176 to 212) and Defendant No. 4/X Corp. shall take down and disable the URL mentioned at page 213, in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.”The matter is now listed before the Joint Registrar on September 26.Appearance: Ms. Neha Khanduri and Mr. Achal Mittal, Advocates for Plaintiff; Mr. Varun Pathak, Mr. Akhil Shandilya and Mr. Mrityunjay Roy, Advocates for D-2 and 3.
