Delhi High Court Records Evidence By 'Live Transcription' In Patent Infringement Suit

In a first, the Delhi High Court recently recorded evidence by way of live transcription while hearing a patent infringement suit. Justice Prathiba M Singh recorded and concluded the cross-examination of two plaintiff witnesses and two defendant witnesses using live transcription with the consent of the parties in open court. The transcription agency engaged was Opus 2 Limited.The court was dealing with a suit filed by Communication Components Antena Inc alleging infringement of its patent titled ‘Asymmetrical Beams for Spectrum Efficiency’ by Rosenberger, a company which manufactures and sells high-voltage and fiber optic technologies. It was the plaintiff’s case that its patent was related to a method and apparatus enabling the increase in subscriber capacity and enhancing performance of a base station. It alleged that Rosenberger was found to be selling telecom antennas, thereby infringing the suit patent. On September 20, the court recorded and concluded the cross-examination of two plaintiff witnesses who were the President of Communication Components Inc. and the Managing Director of M.S.C. Wireless Ltd. Both of them joined the proceedings virtually. “The transcription agency shall e-mail the final version of the transcription as also the audio recording for the cross examination to the Court Master. The edited transcription for today, incorporating any corrections directed by the Court shall be read through by the two witnesses on 21st September, 2023,” the court said. On September 22, Justice Singh concluded the cross examination of two defendant witnesses and appreciated both the sides as well as the witnesses for adhering to the fixed schedule. “The Court records appreciation of both the counsels as also respective witnesses for broadly adhering to the schedule fixed by the Court. Over a period of two days i.e., on 20th September 2023 and 22nd September 2023, the Plaintiff’s and the Defendant’s evidence is concluded, after recording the cross examination of four witnesses – two technical witnesses and two fact/in-house witnesses, from each side,” the court said. Justice Singh directed the transcription agency to e-mail the final version of the transcription and the audio recording for cross examination to the court master as well as to lawyers of both the parties.
