Delhi High Court Quashes FIR Against Man Accused Of Assaulting Doctor, Orders Community Service At Same Hospital

The Delhi High Court has quashed an FIR against a man accused of assaulting a doctor on duty, asking him to do one month community service at the same hospital. Noting that the parties resolved their dispute amicably, Justice Ajay Digpaul directed the accused to perform community service for a month on every Saturday and Sunday at Dr. Sushma Jindal Hospital in city's Dilshad Garden area, under the supervision of the doctor whom he allegedly assaulted. The Court quashed the FIR registered against one Vipin Ahuja in 2019 for the offences under Section 506 of the Indian Penal Code, 1860, and Section 4 of Medicare Service Persons and Medicare Service Institutions (Prevention of Violence and Damage of Property) Act.It was alleged that Ahuja, being the attendant of a patient, allegedly created a ruckus in the hospital, physically assaulted the doctor on duty and called others who further abused the staff and disrupted the hospital work.The Court was informed that Ahuja and the doctor had settled their disputes amicably and were moving forward towards a peaceful and harmonious future.A settlement deed was entered into between the parties in January wherein the doctor agreed to withdraw the FIR registered against Ahuja, who then filed the petition seeking quashing of the FIR. The doctor categorically told Court that he had entered into compromise on his own free will and without any pressure and also expressed his desire to forgive and not to pursue the matter further. Considering the settlement and the fact that no grievous injury was caused, the Court observed that no useful purpose would be served by continuation of the criminal proceedings. At the same time, it added, that the Court cannot lose sight of the fact that an act of assault upon a medical professional in a hospital not only endangers the life of doctors and staff, but also jeopardises the treatment of other patients in need of urgent care.“…FIR No. 280/2019 registered at Police Station Anand Vihar, for the offences punishable under Section 506 of the IPC and Section 4 of Medicare Service Persons and Medicare Service Institutions (Prevention of Violence and Damage of Property) Act, and consequent proceedings emanating therefrom, are quashed qua the present petitioner, subject to the petitioner performing community service starting from 27.09.2025….,” the Court ordered.Title: VIPIN AHUJA v.
