Delhi High Court Grants Bail To Alleged ISIS Operative In Terror Module Case After 5 Years In Custody

The Delhi High Court on Thursday granted bail to a man accused in a UAPA case registered by the National Investigation Agency (NIA) over allegations of being an operative of the Harkat-ul-Harb-e-Islam, an ISIS affiliate terror outfit.
A division bench comprising Justice Navin Chawla and Justice Arun Bhardwaj granted bail to Mohd Shahzad Kamal who is accused of being involved in a conspiracy to arrange and channelize terror funds from Saudi Arabia to support the terror module's activities in India.
A detailed order is awaited.
The Bench allowed the appeal filed by Kamal challenging a special court order passed on May 29, 2024, denying him bail in the case. He has been in custody since August 31, 2021.
UAPA charges were framed against him on August 30, 2022.
As per NIA, the investigation revealed that Kamal provided funds on multiple occasions (from February, 2017 till January, 2019) to co accused Mohd. Absar in order to fund the terrorist activities of the terrorist gang.
It was also alleged that Kamal was in constant touch with co accused Md. Saqib through Facebook and WhatsApp and there were retrieved conversations between them discussing about funds to be transferred or provided by Kamal for Jihadi purpose.
The NIA alleged that chats revealed that Kamal was also supporting Tehreek-e-Azadi Jammu Kashmir and was totally radicalized with the ideology of Jihad and of terrorist gang 'Harkat-Ul-Harb-E-Islam' affiliated to ISIS.
Kamal had sought bail on the ground that chargesheet and documents did not contain any material which could be converted into legal evidence against him at trial.
He argued that if there was no material that could be converted into evidence at trial, there could be only one result at the conclusion of the trial— acquittal.
