Delhi High Court Grants John Doe Order Awarding Dynamic Interim Injunction Protecting Tata Pay Trademark

The Delhi High Court has granted an ex-parte ad-interim dynamic injunction, protecting the trademark of Tata Group's payment solutions platform Tata Pay.Justice Tejas Karia restrained unknown entities from infringing the group's 'TATA' and 'TATA PAYMENTS' marks.Tata contended that Tata Digital Private Limited serves as its financial services arm, engaged in providing a wide range of payment solutions through a RBI Payment Aggregator license.It claimed that in the first week of July 2025, it came across the website of Defendant No. 1 “https://www.tatapayment.net/” which wholly incorporates its registered marks, to provide digital payment services for businesses and individuals across India.Tata alleged there is clear intent to defraud and deceive the unwary consumers by riding off its goodwill.While the owners of the website are not known, Tata said the impugned website mentions a Telegram account, which contains Chinese text and appears to facilitate the establishment of overseas payment systems under the name 'TATA Payment System for Rent'.The High Court has thus directed Telegram FZ-LLC to temporarily block the account and further, provide its IP addresses, owner's name, contact details, etc. in a sealed cover.Meanwhile, Cloudfare Inc has also been directed to block access and suspend registration of the Impugned Website.The court further ordered, “In the event further accounts / groups / channels resembling the nature of the 'TATA' or 'TATA PAYMENTS' Marks surface on Telegram, the Plaintiffs are at liberty to share the concerned URLs with Defendant No. 3, who shall thereafter remove / block access thereto.”Summons have been issued in the main suit and the matter is next listed on November 24.Appearance: Ms. Shwetasree Majumder, Mr. Prithvi Singh, Mr. Rohan Seth, Mr. Prithvi Gulati, Mr. Ritwik Marwaha & Ms. Vanshika Singh, Advocates for Plaintiff; Ms. Anushka Sharda, Advocates for Defendant No.3.
