Delhi High Court Grants Bail To Murder Accused To Undergo Surgery, Asks Him To Mark Attendance By Video Calling IO

The Delhi High Court recently granted medical bail to a murder accused seeking to undergo laser surgery for Varicose Veins, subject to his marking attendance with the Investigating Officer on video calls.Ordinarily, those on bail are required to visit the jurisdictional police station in person to mark their attendance with the IO.However, while setting out the conditions for bail in this case, Justice Shalinder Kaur ordered:“The Petitioner shall make a video call to the concerned Investigating Officer at the concerned Police Station twice in a week, on Monday and Thursday, between 4:00 PM to 6:00 PM, except on the day his surgery will be performed, for marking his presence.”The Petitioner was earlier released on custody parole to undergo treatment at Wanshika Medicare, Safdarjung Enclave, New Delhi. As the doctors advised him to undergo laser treatment, he sought interim bail for a period of 45 days.Counsel appearing for Petitioner submitted that for the successful execution of the aforesaid medical procedure, the petitioner is required to remain admitted in the hospital for a period of 2–3 days. As a post-surgical measure, he will further require bed rest for approximately 10–15 days, during which he will be unable to walk or perform his daily activities. The Additional Public Prosecutor on the other hand sought dismissal of the bail application on the ground that allegations against him are grave and the said treatment can be availed at Deen Dayal Upadhyay Hospital, Delhi, while the petitioner is in custody.After hearing the parties, the Court allowed the plea and admitted the petitioner to interim bail for a period of two weeks, on his furnishing a personal bond in the sum of Rs. 50,000/- with two sureties in the like amount.He has been directed to give all his mobile numbers to the Investigating Officer and keep it operational at all times.Appearance: Mr. Ankit Rana, Adv. for Petitioner; Ms. Meenakshi Dahiya, APP for State with SI Rajesh Kumar, PS Mukherjee Nagar.Case title: Maninder Sidhu v.
