Delhi High Court Issues 'Real Time' Injunction Restraining Entities From Misusing Reliance's Tira Trademark To Commit Financial Scams

The Delhi High Court has issued interim directions restraining infringement of Reliance Retail's Tira trademark in the beauty and personal care sector and its misuse to commit financial scams.Noting that the defendant had been employing numerous rogue mobile numbers to hide the true identity of the entity(s) involved, Justice Saurabh Banerjee granted real time relief to the plaintiff against any rogue mobile numbers that may be discovered by it subsequently.“The facts disclose that the acts of the defendant no.1 is nothing short of blatant impersonation with a view to defraud the unwary and innocent consumers who are only there for engaging themselves with the trademark Tira of the plaintiff,” the bench observed.Reliance alleged that defendant no.1 is/ are unknown entity(s) engaged in systematic and coordinated fraudulent activities targeting its customers by approaching them via phone calls and/ or WhatsApp messages through different phone numbers (rogue mobile numbers), using the Tira and related trademarks to pose as representatives of the plaintiff and orchestrating financial scams.It was alleged that the defendant uses fabricated gift cards/ promotional codes for electronic items, purported cancellation of Cash-on-Delivery orders unless immediate payment is made and false claims of payment failures in prepaid orders, whereafter it demands payment(s) on different UPI accounts/ QR Codes.It is alleged that around 8,919 cases have been filed by consumers over a span of approximately two months across different cities in India and they have been defrauded for a total amount exceeding INR 41 lacs.The Court has directed the Telecom Service Providers to block and suspend the rogue mobile numbers, Whatsapp to block and suspend the WhatsApp accounts associated with the rogue mobile numbers and National Payments Corporation of India to block and suspend the UPI accounts/ QR Codes associated with the rogue mobile numbers.The case is next listed on November 06.Appearance: Mr. Sandeep Sethi, Sr. Adv. with Mr. Sai Krishna Rajagopal, Mr. Sidharth Chopra, Mr. Yatinder Garg, Ms. Disha Sharma and Mr. Abjay Aren, Advs. for PlaitniffCase title: Reliance Retail Limited v.
