Delhi High Court Quashes Assault FIRs; Asks Parties To Provide Chaach, Pizzas To Ashram Inmates

While quashing two FIRs alleging assault and misbehaviour between neighbours, the Delhi High Court has directed the parties to provide Amul Chaach and Mix Vegetable Pizzas to the inmates residing at an Ashram in city's Dilshad Garden. Justice Arun Monga said that the act shall be treated as community service to be jointly carried out by all the complainants and the accused persons. The Court allowed the plea filed by the parties seeking quashing of the FIRs on the ground that a compromise was arrived at between them. The dispute was in relation to the handling of their respective pets.Both the FIRs arose out of the same incident. It was alleged that a heated altercation degenerated into an unsavoury scuffle, wherein each side alleged assault, intimidation, and misbehaviour by the other party. The Court noted that while one of the complainants was in the business of baking and selling pizzas, the complainant in the other cross FIR was a respectable citizen. The Court said that continuation of the criminal proceedings would serve no useful purpose and would rather amount to an abuse of the process of law.It added that not quashing the criminal proceedings would rather rekindle hostility, whereas quashing the same would promote cordiality and bonhomie between the neighbour. Quashing the FIRs to prevent undue hardship to the parties and promote mutual goodwill and societal harmony, the Court ordered:“However, both the complainants in the two FIRs are directed to join hands and jointly bear the expenses, which shall be incurred for providing Amul Chaach Tetra Pack along with Mix VegetablePizzas to the inmates who are currently residing at Sanskar Ashram, Near G.T.B Hospital, Dilshad Garden, Delhi. Each inmate and the attendants and other staff of the Ashram shall be served one Pizza along with Amul Chaach Tetra Pack.”“Soft copy of the menu has been forwarded on the whatsapp of the I.O., who will ensure that quality of the pizza is same as has been stated in the menu,” it added.Title: ARVIND KUMAR AND OTHERS v.
