Delhi High Court Relaxes Deadline For Constituting School-Level Fee Regulation Committees Till Feb 20

The Delhi High Court on Monday directed that schools in the national capital which have not yet constituted the School-Level Fee Regulation Committee (SLFRC) shall not be compelled to do so until February 20, while it considers challenges to the Delhi School Education (Removal of Difficulties) Order, 2026. A Division Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia passed the interim order in petitions filed by the Forum of Minority Schools and the Forum for Promotion of Quality Education for All, assailing the notification issue by the Delhi Government on February 01. The impugned notification “Removal of Difficulties Order, 2026” mandates that every school must constitute the SLFRC by February 11. The petitioners sought extension of this deadline, contending that the validity of the notification itself was under challenge before the High Court .Opposing the plea, Additional Solicitor General S.V. Raju, appearing for the Delhi Government, argued that any further extension would disrupt the statutory timeline fixed for fee determination for the academic years 2026–27 onwards. He submitted that the Court had already granted an extension earlier till January 20, and any additional relaxation would derail the fee fixation process. The Bench noted that the legal and factual circumstances had materially changed following the Supreme Court's orders wherein the Delhi Government had clarified that the new law would not be implemented for the academic year 2025–26. The Supreme Court had then left all issues, including the challenge to the notification open for consideration by the High Court. The Court said that it has fixed the application seeking stay for appropriate decision on February 20, and that the Delhi Government did not insist on formation of the School-Level Fee Regulation Committee by the next date. “…/no prejudice is going to be caused to either side neither will it cause any prejudice to the timeline, which has been fixed for fixation of fee for the academic session 2026-27,” the Court said. “Accordingly, we provide that till the next date of listing of the application for stay, i.e.20.02.2026, those schools who have not constituted the School-Level Fee Regulation Committee shall not be insisted upon to form this said Committee,” it ordered.
