Delhi High Court Restrains Two-Wheeler Manufacturer From Using 'Destiny' Marks Similar To Hero Motocorp

The Delhi High Court has restrained Sunanda Greentech Pvt. Ltd., an electric two-wheeler manufacturer, from producing or selling scooters under the marks “Destiny”, “Destiny+”, “Destiny Pro” and “Dest Pro,” after finding them deceptively similar to Hero MotoCorp's registered “Destiny/Destini” trademarks. The court held that the similarity in both the marks and the product category was likely to mislead consumers into believing that Sunanda Greentech's scooters were associated with Hero MotoCorp. The ex-parte ad-interim injunction was issued on November 27, 2025, by Justice Manmeet Pritam Singh Arora in a trademark infringement and passing-off suit. The order will remain in force until April 28, 2026. Hero MotoCorp told the Court that it has been selling scooters under the “Destiny/Destini” mark since 2018 and holds valid registrations for these marks. The company said it discovered in June 2025 that Sunanda Greentech was manufacturing and marketing electric two-wheelers using “Destiny” and related marks. A cease-and-desist notice was served on Sunanda Greentech, but the company did not respond. After reviewing the material on record, the court noted that Hero MotoCorp was the prior adopter and registered proprietor of the mark, while Sunanda Greentech was selling identical goods using marks that were structurally, phonetically and visually similar. “The Defendant's use and adoption of the deceptively similar Plaintiff's Marks for identical goods appears to be intentional to ride upon the reputation and goodwill enjoyed by the Plaintiff,” the court said.Finding that Hero MotoCorp had made out a case for interim protection, the Court restrained Sunanda Greentech and its associates from using “Destiny”, “Destiny+”, “Destiny Pro”, “Dest Pro”, or any other deceptively similar mark for two-wheelers or related goods. The company has also been barred from using any indication that could suggest its products are connected with Hero MotoCorp. The matter will next be listed on April 28, 2026.
