The Delhi High Court has quashed an FIR registered against five persons for offences including attempt to culpable homicide and assault on public servant after the parties amicably settled their dispute. [2026 LiveLaw (Del) 862]

Justice Purushaindra Kumar Kaurav directed them to donate furniture worth of Rs. 50,000, Rs. 10,000 each, to government schools near their place of residences.

The Court quashed the FIR registered at Police Station Subhash Place. It was registered for the offences under Sections 323 (causing hurt), 341 (wrongful restraint), 186 (obstruction of a public servant), 332 (causing hurt to a public servant), 353 (assault), 308 (culpable homicide not amounting to murder), 506 (criminal intimidation) and 34 (common intention) under Indian Penal Code, 1860.

The Court was informed that the FIR was lodged by the complainant due to a misunderstanding between the parties.

It was also submitted that the parties subsequently entered into a settlement deed dated August 11, pursuant to which the complainant stated that he did not want any action to be taken against the accused persons.

The complainant also stated before the Court that his decision was voluntary and was not the result of any coercion or pressure. The State did not oppose the quashing of the FIR in view of the settlement.

The petitioners, meanwhile, expressed their willingness to undertake community service or assist a government school with infrastructure.

Considering the nature of the dispute, the settlement between the parties and the principles laid down by the Supreme Court, Justice Kaurav quashed the FIR and all consequential proceedings against the accused persons.

However, the Court directed the five petitioners to donate furniture worth Rs. 50,000 in total to government schools situated near their localities.

The Court also directed the parties to adhere to the terms of their settlement.
