Delhi High Court Issues Notice To 'X' User On Gaurav Bhatia's Plea Alleging Breach Of Interim Order Restraining Defamatory Posts

The Delhi High Court on Thursday issued notice on a plea filed by Senior Advocate and BJP leader Gaurav Bhatia seeking take down of content uploaded by a X (formerly Twitter) user alleging that the same is in wilful disobedience of an interim order passed in his defamation suit. Bhatia has filed the fresh application against user “Ranting Gola” alleging that despite the interim order passed in September last year, she has been uploading video and content in defiance. For context, Bhatia last year filed the defamation suit over his appearance on a TV debate, which went viral on social media.The suit was filed against various individuals, including Ranting Gola and Congress leaders. The coordinate bench had directed take down of two allegedly defamatory social media posts (by Samajwadi Party Media Cell and Sandeep Singh), observing that attacking the dignity of a person using obscene and sexually suggestive language under the guise of free speech cannot be permissible under any circumstances.During the hearing today, Advocate Raghav Awasthi appearing for Bhatia before Justice Mini Pushkarna said that the user in question has been posting about the interim order on X, which is in violation of the interim order. Bhatia, appearing in person through VC, said that there is an urgency in the matter as the tweet is contrary to the interim order and deserves to be removed immediately. It was submitted that the interim order, in unequivocal terms, in direction 36(c) had “restrained the defendants from posting, circulating or publishing any content qua Bhatia which is explicit, obscene or sexually suggestive in nature on any online or offline platform.”It was argued that Ranting Gola, in conscious defiance of the interim order, has published a fresh video from her handle. Accordingly, the Court issued notice in the application and sought response of the user as well as X.The matter will now be heard on April 22. Title: Gaura Bhatia v.
