Delhi High Court Restrains Rogue Websites From Streaming Maalik, Sarbala Ji Movie Content

The Delhi High Court has restrained 56 rogue websites from illegally and unauthorisedly streaming content of Maalik and Sarbala Ji movies.Justice Amit Bansal passed an ad-interim injunction order in favour of Tips Films Limited in its copyright infringement suit against the websites. The Court directed the domain name registrars to lock and suspend the domain name registration of the defendant rogue websites. “If any website, which is not primarily an infringing site, is blocked pursuant to the present order, they shall be permitted to approach this Court by giving an undertaking that it does not intend to engage in any unauthorized streaming of any content, over which the plaintiff has rights,” the Court said. It was submitted by Tips Films that majority of the rogue websites were anonymous in nature and the information provided in the public domain regarding the owners of the website was either incomplete, incorrect or protected behind a veil of secrecy.It was contended that the defendant websites hide behind domain privacy services offered by various Domain Name Registrars, which enable a website owner to hide behind a veil and not disclose any contact details publicly, to protect his privacy. In its interim order, the Court directed the DNRs to disclose complete details as well as mode of payment along with payment details used for registration of domain name by the rogue websites. “The defendants no. 81 to 89, their directors, partners, proprietors, officers, affiliates, servants, employees, and all others in capacity of principal or agent acting for and on their behalf, or anyone claiming through, by or under it, are directed to block access to the various websites,” it added.
