The Delhi High Court has granted bail to a 20-year-old woman booked under the Protection of Children from Sexual Offences Act, 2012 on allegations of sexually assaulting a minor boy, after noting that the victim's mother had no objection to her release, subject to her refraining from any such conduct in future. Justice Manoj Jain passed the order in a bail application arising out of an FIR registered at Chanakyapuri Police Station under Section 351(2) of the Bharatiya Nyaya Sanhita and Sections 6 and 8 of the POCSO Act.

The FIR was registered on the basis of a PCR call made by the victim's mother, who alleged that the accused had forcibly established physical relations with her minor son. The charge sheet had already been filed and contained the victim's statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita.

According to the prosecution, the accused, who was a neighbour of the complainant, called the 15-year-old boy to her house in February 2026 and established forceful sexual contact with him. It was further alleged that she subsequently assaulted him at his own residence in March 2026 and threatened him against disclosing the incidents to anyone.

The applicant on the other hand contended that the allegations were false and stemmed from a family dispute between the parties. She had also relied on the fact that she was the mother of a three-year-old girl whose health was allegedly being adversely affected by her incarceration.

The Court noted that the applicant was 20 years old, had remained in custody for more than three-and-a-half months and had no previous criminal antecedents. Her conduct in jail was also found to be satisfactory.

“...the mother of the victim boy stated that she would have no objection to the grant of bail, provided the applicant is directed to resist from any such act or endeavour in future,” it further noted.

Counsel for the applicant also submitted that she would maintain complete distance from the complainant's family and shift from her existing residence.

As such, the Court granted bail subject to applicant furnishing a personal bond, not contacting witnesses and keeping her mobile phone operational throughout the pendency of the case.
