Unnao Custodial Death: Delhi High Court Asks AIIMS To Examine Jaideep Sengar's Health After CBI Flags 'Fake' Cancer Prescriptions

The Delhi High Court has directed constitution of a Medical Board at All India Institute of Medical Sciences to independently assess the health condition of Jaideep Singh Senger, brother of Unnao rape case convict Kuldeep Sengar.
A division bench comprising Justice Navin Chawla and Justice Ravinder Dudeja was dealing with Senger's application seeking interim suspension of his sentence on medical grounds in relation to his conviction in the custodial death case of the survivor's father.
Senger claimed that he was suffering from serious and life-threatening medical conditions, including Stage-IV oral cancer with suspected recurrence, osteoradionecrosis (ORN), trismus, and chronic infection of the jaw.
However, the Central Bureau of Investigation (CBI) alleged that several medical documents filed by him were fake. It was submitted that while certain records relating to past treatment were verified as genuine, there was no credible material establishing that Senger was presently suffering from Stage-IV cancer.
The Bench observed that an independent medical assessment by a duly constituted Medical Board was necessary to ascertain the current health condition of Senger.
The Court directed the Director of AIIMS to constitute a Medical Board to conduct a comprehensive evaluation of Senger and report on:
- Whether he is suffering from cancer or any other life-threatening disease, and if so, at what stage; and
- Whether the required treatment can be adequately provided within the jail hospital or through escorted visits to government hospitals.
The Bench directed the Jail Superintendent to produce Senger before the Medical Board and ensure that all available medical records are furnished to it.
Senger has also been permitted to place his prior medical history before the Board. The matter is listed for further consideration on March 02.
The Court had granted interim bail to Jaideep Sengar on July 03, 2024, for two months on medical grounds.
On March 13, 2020, Kuldeep Sengar, along with Jaideep Sengar, was sentenced to 10 years' rigorous imprisonment by the trial court, which also imposed a fine of Rs 10 lakh, in the custodial death case of the rape survivor's father.
Kuldeep Sengar was convicted and sentenced to imprisonment for the remainder of his life on December 20, 2019, for raping the minor in 2017.
