Will Withdraw Order Taking Over Private School After Stabbing Incident, Take Fresh Decision: State Tells Gujarat High Court

The Gujarat government told the High Court on Tuesday (April 28) that it will withdraw its December 15, 2025 order taking over the management of a private school in Ahmedabad following the stabbing of a Class 10 student by another in August last year, and take a fresh decision.The court was hearing the school's appeal challenging a single judge's order which had refused to grant ad-interim relief to permit admission of new students in the school's writ petition.During the hearing on Tuesday, Advocate General Kamal Trivedi appearing for the State submitted before a division bench of Chief Justice Sunita Agarwal and Justice DN Ray that the order dated 15-12-2025 would stand withdrawn and management would be restored to the petitioners within a period of 3 days from today.As regards two inquiries initiated against the petitioner school, it was submitted that both the inquiry reports of District Education Officer and Committee constituted by Director, Primary Education shall be supplied to petitioners calling for their explanation and a decision will be taken after providing due opportunity of hearing to the petitioners.The court in its order noted that Senior Advocate Mihir Joshi appearing for the School had no objection to these submissions by the State.In view of the same the court disposed of the writ petition out of which the appeal arises, leaving it open for respondents to do the needful in a time bound manner. "However it is kept open for petitioner to approach the court again in case of any grievances left with the issue subject matter of present petition. It is clarified we have not entered into merits of the claims of the parties and all rights and contentions of the parties are left open," the court dictated in its order.Earlier last year, the state authorities had issued a show cause notice asking why the school's NOC should not be cancelled. Further the District Education Officer (DEO) had initiated an inquiry into the incident under the Bombay Primary Education Act, 1947, the RTE Act, 2009, the Gujarat RTE Rules, 2012, the School Safety Policy and the Indian School Certification Examination Affiliation Rules etc.Case title: SEVENTH DAY ADVENTIST HIGHER SECONDARY SCHOOL & ORS. v/s STATE OF GUJARAT & ANR.R/LPA/296/2026 IN R/SCA/836/2026
