Surat Demolitions: Gujarat High Court Closes Resident's Plea After Municipal Corporation Assures No Immediate Action Planned

Court said in case the Corporation intends to take coercive action against the property, it will do so as per law.
The Gujarat High Court disposed of a resident's plea apprehending demolition of his home by Surat Municipal Corporation, after the authority said that as of now it does not intend to demolish the property and if it does intend to do so, it will issue a notice to the resident and take steps as per law.
The petitioner had moved the high court on an apprehension that his residential accommodation may be demolished by Surat Municipal Corporation, particularly when the premises adjacent to petitioner's house have been demolished by the Corporation.
Meanwhile the Corporation submitted that the issue with regard to the demolition is being looked into by the court in another matter–Special Civil Application No. 8712 of 2026, and as far as the petitioner's property is concerned, the Corporation is not intending to demolish the same as of now. It was submitted that in case the Corporation would seek to take any steps, it would do so in accordance with law–meaning that the petitioner would be issued appropriate notice and the procedure as per the law would be followed.
Noting the same, Justice Nikhil S Kariel in his order said:
"Considering the statement made by learned Advocate Mr. Anuj Trivedi, to this Court it would appear that nothing further is required to be done, except directing the respondent-Corporation to take appropriate steps in accordance with law, if some coercive measures are intended to be taken against the property in question".
The plea was disposed of.
Meanwhile the high court had while hearing a separate matter concerning demolitions carried out in Surat's Nasir Nagar had earlier orally said that the action was a "complete illegality" where around "100 families had been displaced".
