HP Govt Can Create Separate Sub-Cadre For CBSE Schools, Select Teachers Through Written Test & Counselling: High Court

The Himachal Pradesh High Court upheld the State Government's policy creating a separate sub-cadre of teachers for CBSE-affiliated government schools and mandating selection through written examination and counselling for in-service teachers.The Court noted that the policy ensures a fair, transparent, and merit-based mechanism of selection, and falls within the executive powers of the State under the Constitution, rejecting challenges alleging arbitrariness and discrimination.Division bench of Justice Vivek Singh Thakur and Justice Ranjan Sharma remarked that: “The criteria of selection in Para 5.5. of the Sub-Scheme prescribes a just and transparent mechanism of selection for filling up of posts from in-service teachers… giving an equal opportunity to desirous eligible in-service teachers… to apply and compete for said posts.” Additionally, while rejecting the challenge to the policy framework, the Court held:“The powers of the State executive do extend to matters upon which the State Legislature is competent to legislate and are not confined to matters over which legislation has been passed already.” Background:The petitioners, comprising teachers' associations and in-service teachers, challenged the State Government's Scheme for CBSE Affiliated Schools of Excellence (2026), particularly Para 5.5 of the Sub-Scheme providing for creation of a sub-cadre of teachers and in making the existing teachers to undergo selection, by way of written test and counselling. They further contended that the policy altered existing service conditions and created a “class within a class”, making it arbitrary and discriminatory to subject experienced teachers to a fresh selection process. It was argued that the scheme would lead to uncertainty, demoralisation, and disruption in the academic environment, rendering it unfair and unsustainable in law.The State defended the impugned policy by asserting that the Scheme for CBSE Affiliated Schools of Excellence (2026)was framed in line with the National Education Policy, 2020 to upgrade government schools to national standards.
