Karnataka High Court Grants 3-Day Emergency Parole To Disabled Life Convict To Attend Sister's Wedding Event

The Karnataka High Court on Friday (February 27) granted parole 3-day emergency parole to a visually disabled man–convicted for various offences including kidnapping and sentenced to life, to enable him to attend his sister's wedding functions. The plea moved by the convict's mother stated that her son has 77% permanent visual disability (blindness) which has been certified by a hospital and he has also been issued a Unique Disability Identity Card by Government of India. The plea further stated that the convict's sister has locomotor disability and that various customary and matrimonial ceremonies connected with her marriage are scheduled to be conducted from 25.02.2026 to 01.03.2026. The plea stated that due to the physical condition of both the children, the presence of the convict during the marriage of his sister is not only emotionally significant but practically necessary to assist in performing customary and familial obligations.Justice BM Shyam Prasad in his order noted that the Chief Superintendent of Central Prison, Mysuru had called for a Report from the jurisdictional police on whether there was a wedding happening. The jurisdictional Police had filed a Report stating that there is a wedding and that his sister is getting married on 26.02.2026 at Pandavapura. Counsel for the petitioner, advocate Aditya S K did not dispute that the petitioner's son has filed an appeal against the judgment of conviction but argued that no application for bail has been filed in the appeal. He said that the Court may consider, in the peculiarities of the case, to admit the petitioner's son on emergency parole for a limited period to attend a "wedding event" on 01.03.2026 on terms that are reasonable contending that the petitioner's other children are physically impaired. The court thereafter said:"This Court opines that when an appeal is pending against a judgment of conviction, the appropriate course would be to move an application in the pending proceedings. However, in this case where the wedding in the family is not in dispute, and because it is stated that the appeal is being conducted by a counsel who is appointed by the Karnataka Legal Services Authority and that the petitioner could not reach the learned counsel in time, this Court is persuaded to admit the petitioner to emergency parole for a limited period and on terms...The petition is allowed directing the third respondent to admit the petitioner's son [Sri Chetan S] to emergency parole of three days on the condition that the petitioner's son shall return to the prison on 03.03.2026 and subject to the petitioner executing surety as required under the Karnataka Prisons and Correctional Services Manual, 2021 stipulating that the petitioner's son shall mark his presence with the jurisdictional police on each day to ensure that there is no occasion of law and order situation".
