Kerala High Court Reserves Verdict In Appeal Moved By ADM Naveen Babu's Wife Seeking CBI Probe Into His Death

The Kerala High Court has reserved its orders in the writ appeal moved by deceased ADM Naveen Babu's wife against the refusal to order a CBI probe into her husband's death.ADM Naveen Babu was found hanging in his official quarters on October 15, 2024. PP Divya, a member of the Communist Party of India (Marxist) which has currently formed the government in Kerala is accused of abetting Babu's suicide by humiliating him in public, during his farewell function. Babu's wife alleged a homicidal angle to the incident and argued that due to Divya's political influence, the investigation must be carried out by an impartial and independent agency like the CBI or Crime Branch, rather than the Special Investigation Team (SIT). The Division Bench of Justice P.B.Suresh Kumar and Justice Jobin Sebastian asked the appellant if they were alleging any kind of malice against the SIT who is investigating the matter now. The Court opined that the appellant has not made out sufficient reasons for ordering a CBI probe. The Counsel for the appellant, Senior Advocate S Sreekumar submitted that Naveen Babu's family seeks a fair investigation and expressed a lack of trust in the present investigation. It was argued that Divya, who is accused of abetting Naveen Babu's death is closely connected with the ruling party and alleged that the investigation might not be impartial. It was argued that the investigation must be handed over to an independent and impartial agency like the Crime Branch. It is stated that even after raising suspicion of homicide, the SIT has not investigated this aspect. It was also submitted that the Court must seek for report from the present investigation agency regarding their investigation into the homicidal hanging. It was stated that call records of Divya and the District Collector of Kannur must be preserved to find out the larger conspiracy behind Naveen Babu's death.
