Kerala High Court Reserves Order On Plea For CBI Probe Into Alleged Phone Tapping Case Involving Ex-MLA PV Anvar

The Kerala High Court has reserved its orders on the writ petition seeking CBI investigation into the alleged case of illegal phone tapping by former Nilambur MLA P.V. Anvar (13th respondent).The petitioner, who is a business man, has alleged that Anvar illegally tapped his phone to take vengeance. According to the petitioner's affidavit, the ex-MLA has tapped the telephone conversations of many persons, including high police officials and politicians. The petitioner submitted that for this reason, there would not be a fair and impartial investigation into the case. Thus, he filed the present writ petition stating that there is a need for investigation by the CBI or any national Agency considering the seriousness of the crime.When the matter came up for consideration today (June 26), the ex-MLA's counsel submitted that the complaint filed by the petitioner before the Kerala State Police Chief (Exhibit P5) was already considered by the District Police Chief Malappuram. Moreover, an FIR (Exhibit P7) was also registered against Anvar and therefore, the writ petition can be set aside.Justice P.V. Kunhikrishnan orally observed that he was not inclined to dismiss the petition. Further, the bench also orally observed that the State Police Chief can be directed to consider Exhibit P5 complaint preferred by the petitioner.Detailed judgment in the case is awaited.BackgroundThe petitioner has stated in his affidavit that Anvar openly admitted in a press conference in 2024 that he has illegally tapped the phone calls of top police officers, politicians and other persons. It was further stated that the petitioner, who is a business man, came to know that the ex-MLA did the same to him and thereafter, he sent a written complaint to the Police Chief and others. Consequently, a crime was registered, as per the petitioner.As per the affidavit, the petitioner has requested for a thorough investigation into the aforesaid two cases. According to him, a fair and impartial enquiry into the matter would not be possible since there are allegations against top police officials and politicians. Therefore, he has prayed before the Court to entrust the investigation to the Central Bureau of Investigation or any other competent National Agency.The petition was moved by Advocate Peeyus A.
