Palakkad MLA Rahul Mamkootathil Moves Kerala High Court Seeking Pre-Arrest Bail In Rape Case

Palakkad MLA Rahul Mamkootathil has moved the Kerala High Court seeking anticipatory bail in the rape and miscarriage case alleged against him.
Yesterday, his plea before the Principal District and Sessions Court was dismissed noting that serious allegations have been made out against him, prima facie.
Mamkootathil is arrayed as the 1st accused in the crime registered by the Nemom Police and is accused of the offences under the Sections 64(2)(f), 64(2)(h), 64(2)(m) [Rape], 89 [Causing miscarriage without woman's consent], 115(2) [Voluntarily causing hurt], 351(3) [Criminal intimidation], 3(5) of the Bharatiya Nyaya Sanhita and Section 66(E) of the Information Technology Act [Punishment for violation of privacy].
"As the petitioner is a politician, the opposite side want to encash the present political situation expecting the incoming election...It is a sad state of affair that even in the investigation, influence of politics is playing a lot. This is a highly belated complaint which was directly submitted to the chief minister of Kerala, instead of filing the complaint through the proper channel as established by the procedure contemplated in the BNSS and the decisions of the Hon'ble apex court," states his plea.
The petition is moved by Advocates S. Rajeev, V. Vinay, M.S. Aneer, Sarath K.P., Anilkumar C.R., K.S. Kiran Krishnan, Dipa V., Akash Cherian Thomas, Azad Sunil, Maheswar P., T.P. Aravind, and Akshara S.
